Please read these Terms of Service ("Terms") carefully before using the tools and services provided by Childhood Interventions, LLC ("we," "us," or "our"). By accessing or using our website or Tools, you agree to be bound by these Terms.
1. Description of Services
Childhood Interventions, LLC provides digital documentation tools for early intervention professionals, including:
COS Documentation Tool — a browser-based tool for completing Child Outcomes Summary (COS) documentation under Florida's Early Steps program
Progress Summary Generator — an AI-assisted tool for generating periodic and annual review summaries
These Tools are designed for licensed early intervention providers and developmental specialists. They are professional documentation aids and do not constitute clinical guidance, legal advice, or medical services.
2. Eligibility and Account
To use our Tools you must:
Be a licensed or credentialed early intervention provider, educator, or developmental specialist
Be 18 years of age or older
Have a valid subscription purchased through Gumroad
Use the Tools only for professional, lawful purposes
You are responsible for maintaining the confidentiality of your access credentials and for all activity under your account.
3. Subscription and Payment
Access to our Tools requires a paid subscription. Subscriptions are managed through Gumroad. By subscribing, you agree to Gumroad's terms of service in addition to these Terms.
Subscription fees are charged on the billing cycle selected at purchase. You may cancel your subscription at any time through your Gumroad account. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.
We reserve the right to change subscription pricing with 30 days' notice to active subscribers.
4. Acceptable Use
You agree to use our Tools only for their intended purpose — professional early intervention documentation. You agree not to:
Use the Tools to process or store PHI in violation of HIPAA or applicable law
Share your access credentials with others
Attempt to reverse engineer, copy, or redistribute our Tools
Use the Tools for any unlawful purpose
Attempt to circumvent any security or access controls
5. HIPAA and Provider Responsibility
Our Tools are designed to assist providers with documentation. You, as the provider, are solely responsible for:
Ensuring your use of the Tools complies with HIPAA and all applicable privacy laws
Obtaining any necessary patient/family authorizations
The accuracy and completeness of all documentation you create
Maintaining appropriate safeguards for any PHI you handle
The COS Documentation Tool processes all data locally in your browser and transmits no information externally. The Progress Summary Generator automatically redacts PHI before transmitting data to Google's Gemini API; however, you remain responsible for ensuring no unredacted PHI is submitted.
Childhood Interventions, LLC is not a HIPAA Covered Entity with respect to the COS Documentation Tool. For the Progress Summary Generator, providers should evaluate their own HIPAA obligations before use.
6. Intellectual Property
All content, code, design, and materials comprising our Tools and website are the intellectual property of Childhood Interventions, LLC and are protected by copyright law. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Tools for your professional documentation purposes only.
You may not copy, reproduce, distribute, modify, or create derivative works from our Tools without our express written permission.
7. Disclaimer of Warranties
Our Tools are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Tools will be error-free, uninterrupted, or suitable for any particular purpose. AI-generated content produced by the Progress Summary Generator is provided as a drafting aid only and requires professional review before use in official documentation.
8. Limitation of Liability
To the fullest extent permitted by law, Childhood Interventions, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Tools, including but not limited to errors in AI-generated documentation, data loss, or service interruption.
Our total liability to you for any claim arising from these Terms or your use of our Tools shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Childhood Interventions, LLC, its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Tools, your violation of these Terms, or your violation of any applicable law or third-party rights.
10. Termination
We may suspend or terminate your access to our Tools at any time for violation of these Terms, non-payment, or any conduct we determine to be harmful to our services or other users. You may terminate your subscription at any time through Gumroad.
11. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes arising from these Terms shall be resolved in the courts of Escambia County, Florida.
12. Changes to These Terms
We may update these Terms from time to time. We will notify active subscribers of material changes via email. Continued use of our Tools after changes are posted constitutes acceptance of the updated Terms.
